1. Definitions

In these Terms, the following definitions apply:

• "Platform" refers to the GoDantes website, mobile applications, and related services.
• "Traveler" means a user who books tours or experiences through our Platform.
• "Guide" means a user who offers and provides tours or experiences through our Platform.
• "Services" refers to all services provided by GoDantes through the Platform, including booking and payment processing.
• "Content" includes all text, images, videos, reviews, and other materials posted on the Platform.

2. Account Registration

Eligibility

To use our Services, you must:

• Be at least 18 years old
• Have the legal capacity to enter into contracts
• Provide accurate, complete, and up-to-date registration information
• Maintain the security of your account credentials

Account Responsibility

You are responsible for:

• All activities conducted under your account
• Safeguarding the confidentiality of your password
• Notifying GoDantes immediately of any unauthorized use of your account

3. Services Overview

Guide Services

Our Platform connects Travelers with independent Guides offering tours and experiences. GoDantes acts solely as a facilitator and is not:

• An employer of Guides
• A tour operator or travel agency
• Responsible for the conduct of Guides or Travelers

Booking Terms

When booking a tour or experience:

• Travelers agree to pay the listed price plus any applicable fees
• Guides agree to deliver the service as described in their listing
• Cancellation policies, as specified in each listing, apply to both parties

Payments are processed through our secure escrow system, as outlined in Section 4.

4. Payments & Fees

Payment Processing

All payments are processed securely through our Platform. GoDantes charges:

• A 5% service fee on the total transaction amount, deducted from the Guide’s earnings upon completion of the service
• No additional fees to Travelers for booking through the Platform

Bank transfer fees or other third-party payment processing charges, if applicable, are not included in the 5% service fee and may be deducted separately. Guides may opt to enhance their profile visibility using paid promotional tools, but this is not mandatory and is at their discretion.

Escrow and Refunds

Payments made by Travelers are held in escrow until the service is completed. Upon completion, the Traveler must confirm satisfaction to release the payment to the Guide. Travelers may add an optional tip at their discretion. Refund eligibility is determined by:

• The Guide’s cancellation policy as specified in their listing
• The circumstances surrounding the cancellation
• GoDantes’ discretion in exceptional cases, following a review of evidence provided by both parties

In the event of a dispute, the payment remains in escrow until resolved, as detailed in Section 7.

5. Content & Conduct

User Content

By posting content on our Platform, you grant GoDantes:

• A worldwide, non-exclusive, royalty-free license to use, display, and distribute your content for the purpose of operating and promoting the Platform
• The right to modify or remove content that violates our policies or applicable laws

Prohibited Conduct

Users are prohibited from:

• Posting false, misleading, or illegal content
• Harassing, discriminating against, or otherwise harming other users
• Circumventing the Platform’s payment system
• Using the Platform for unauthorized commercial purposes

Violations may result in content removal, account suspension, or termination, as outlined in Section 6.

6. Liability & Disclaimers

Service "As Is"

Our Platform is provided "as is" without warranties of any kind. While we strive to ensure a seamless and secure experience, we do not guarantee:

• Uninterrupted or error-free service
• The accuracy of listings or user-created content
• The quality, safety, or satisfaction of tours and experiences

To enhance trust, payments are held in escrow until the Traveler confirms satisfaction with the service, as described in Section 4. If issues arise, disputes are handled fairly as outlined in Section 7.

Limitation of Liability

To the maximum extent permitted by law, GoDantes shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits or data
• Damages arising from interactions between users

In disputes, GoDantes will review evidence from both Travelers and Guides to reach a fair resolution. If a Traveler is found to have made fraudulent claims to avoid payment for a satisfactorily completed service, their account may be permanently terminated, prohibiting further use of the Platform. Similarly, if a Guide is found to have committed serious violations, such as unprofessional conduct or breach of these Terms, their account may be permanently suspended, barring them from offering services on the Platform. In severe cases, GoDantes reserves the right to pursue legal action against any user for damages to the company’s reputation or to seek financial compensation. We strongly encourage all users to maintain the highest standards of professionalism and integrity when using our Platform.

7. Governing Law & Disputes

Applicable Law

These Terms shall be governed by the laws of the United Kingdom, without regard to its conflict of law provisions.

Dispute Resolution

In the event of a dispute, you agree to:

• Contact GoDantes promptly to attempt an informal resolution
• Provide relevant evidence, such as communications or documentation, to support your case
• If unresolved, participate in mediation before pursuing litigation
• File any claims within one year of the incident

GoDantes will review disputes impartially, considering evidence from both Travelers and Guides. Payments held in escrow will remain on hold until a resolution is reached. Fraudulent actions, such as false claims or serious misconduct, may result in permanent account termination, as outlined in Section 6.

8. General Provisions

Amendments

We may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

Translations

If translated versions of these Terms are provided, the English version shall prevail in case of any conflicts.

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
